That’s the theory of criminal justice, not a direct quote. You’re taking a theory (for once) and picking out parts and making seem as if everyone under the sun acts in the same way.
That bit asks a question: judging from the circumstances that lead to the trial in question, is the person guilty and should they be punished? Let’s try this: you’re driving along when there’s a flash of light that blinds you for just long enough to lead you out of control and you end up smacking into another car (let’s say it’s on-coming traffic that blinds you and you end up crashing into the guy in front of you). Now, let’s say the guy head of you, the one you crashed into, was not blinded by the light, or at least unaffected to a point where he still maintained control. Are you guilty of crashing into him? Yes. Should you be punished? THAT is what that theory delves into.
There’s also the idea that someone committed manslaughter and as a result, has gone mentally insane. Hell, this happened back in my middle school: two kids were messing with one kid’s guns and the other kid SOMEHOW (details weren’t made clear but it seemed as if he was cleaning a gun and the safety was off and he ended up pulling the trigger somehow) shot his friend in the face, killing him instantly. As a result of being right there, and being responsible, he went insane, literally was committed because he tried to commit suicide shortly after (again, details are sparse so it’s unclear if it was once or several times). Was he guilty of manslaughter? Yes. Should he be punished? Again, it’s situations like that that the theory ends up covering. If the crime is obvious (man gets angry, whips out gun, shoots someone and kills them), then the answer is yes, but once you start entering the gray areas, then you have to think about it some more, and then it becomes case-by-case scenarios. A simple reading of the link you actually provided proves that. Other than the obvious, no one has ever said that in a clear-cut crime if the person on the stand should be punished.

No, today is not a day I volunteer at the VA hospital. And what you are suggesting is disgusting.
I usually work with substance abuse patients, usually alcoholics. We work a joint effort with the pet people partnership at a local university. They have proven that people going horseback riding is a great treatment for substance abusers who also suffer from PTSD. So we take about 20 veterans horseback riding per month.
I think you disrespect these fallen heroes and the sacrifice they made for you.
